Humanitarian and compassionate (H&C) consideration allows certain foreign nationals who would otherwise not qualify in any class to be granted permanent residence status or a permanent resident visa if there are compelling H&C grounds. People with exceptional circumstances are protected on humanitarian and compassionate grounds.

Points to Consider in H&C

Applications are evaluated on a case-by-case basis. Several factors are taken into account during the application process, including:

• The best interests of any children involved
• How settled the person is in Canada?
  
• What will happen to the applicant if the request is denied?
• Factors in the applicant’s home country, including adverse country conditions.
• Applicant’s health considerations include a country’s inability to provide medical treatment.
• Any unique or exceptional circumstances that might need relief
• Consequences of the separation of relatives etc.
